Terms of Service

These terms are between you and VPEAK Realty LLC, a North Carolina limited liability company (“we”, “us”), which operates LandAI Analyst™ at landaianalyst.com. By creating an account or using the service you agree to them. If you are agreeing on behalf of a company, you confirm you may bind it.

VPEAK Realty LLC is a licensed North Carolina real estate brokerage (License #336296). Using this software does not create a brokerage relationship, does not make us your agent, and does not mean we represent you in any transaction. If you want brokerage representation, that is a separate written agreement.

You give us a property address or parcel identifier. We query public and licensed data sources — federal, state and county records, and where available multiple listing service data — and generate an analysis written to the professional lens you select. Reports may be viewed in the app, exported as PDF, or shared by link.

We change and improve the service over time. Data sources may be added or removed, and a source that is available today may not be tomorrow.

Reports are informational. They are not an appraisal, a survey, a title search or title insurance, a flood determination for insurance or lending purposes, an environmental site assessment, a geotechnical or engineering report, legal or tax advice, or a substitute for physical inspection.

Analyses are generated in part by automated systems and large language models. The service is designed to withhold a figure rather than guess at one, and to mark data as missing rather than imply it was checked — but you must independently verify every material fact before relying on it in a transaction. Where a report states a value is unavailable, that means it is unknown, not that the condition is absent.

Third-party data may be incomplete, out of date, or wrong at the source. We do not warrant the accuracy of data we did not create.

You must give an accurate email address and keep it current — it is how we verify your account and send you sign-in links. You are responsible for activity under your account and for keeping your API key secret. An API key is a credential: anyone holding it can use your allowance. Tell us promptly at support@landaianalyst.com if you believe it has been exposed, and we will rotate it.

One person or organisation per account. Do not share credentials across firms.

Free-tier allowances are granted once per account, not per month. Paid plans are billed monthly in advance through Stripe, which processes payments and stores card details — we never see or hold your full card number. Report credits are one-off purchases that do not expire at a billing-period boundary.

You may cancel at any time; cancellation stops the next renewal and you keep access for the period already paid for. Current prices and allowances are on the pricing page, and those figures govern. We will give notice before a price change affects a renewal.

Because analyses consume third-party data and compute as soon as they run, completed analyses are not refundable. If the service failed to produce a usable report, contact us and we will make it right.

You agree not to:

• scrape, bulk-download or systematically extract the service or its outputs beyond your plan's documented API and batch limits;
• resell, sublicense or redistribute raw data obtained through the service as a data product of your own;
• use the service to harass a property owner, or for any purpose prohibited by law;
• use outputs to make decisions about a person's eligibility for credit, insurance, housing or employment — this is not a consumer report and we are not a consumer reporting agency under the Fair Credit Reporting Act;
• attempt to circumvent usage limits, authentication, or another tenant's data boundary.

Reports you generate are yours to use in your business, including with your clients. That licence does not extend to rebuilding a competing dataset or service from them.

Where a report includes multiple listing service content, that content is owned by the relevant MLS and its participants and is provided under licence, for your internal business use in evaluating the specific property. It may not be redistributed, republished, scraped, or used to populate another database or public-facing site. Those restrictions come from the MLS, they survive termination of your account, and we are obliged to enforce them.

We own the service, the software, and the LandAI Analyst™ name, logo and tagline. You own the addresses and inputs you submit. You own the reports we generate for you, subject to section 7 and the underlying rights of data providers.

You grant us the limited right to process your inputs to deliver the service and to use aggregated, de-identified usage data to improve it. We do not sell your data.

The service is provided “as is”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or that any analysis will be error-free.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost transactions or lost data. Our total liability for any claim is limited to the amounts you paid us in the twelve months before the event giving rise to it. Some jurisdictions do not allow these limits, in which case they apply to the fullest extent permitted.

You may close your account at any time by writing to support@landaianalyst.com. We may suspend or terminate an account that breaches these terms, that we reasonably believe is being used unlawfully, or for non-payment. Where practical we will tell you first and give you a chance to fix it.

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws rules, and the courts of Wake County, North Carolina have exclusive jurisdiction.

We may update these terms. If a change is material we will give notice by email or in the app before it takes effect, and the “last updated” date above will change. Continuing to use the service after that means you accept the revision.
